Terms of use
Last updated: October 22, 2026
These Terms of use govern the relationship between you and Gianluca Maria Vitrano for the use of Spoilery. By creating an account or using the service you accept them: please read them carefully. The Privacy policy and the Cookie policy are also part of these Terms.
1. Definitions
"Service": the Spoilery website, its installable app version and all related features. "We" or "operator": Gianluca Maria Vitrano. "User" or "you": anyone using the service, with or without an account. "Content": posts, images, comments, reactions, ratings, names, pictures, bios and any other material published by users. "Staff": the service's administrators and moderators.
2. The service
Spoilery is a community to talk about TV shows and anime episode by episode, with spoiler protection, social features, notifications and catalog information.
The service is currently free. We may introduce advertising or optional paid features in the future: we will tell you beforehand, and no paid feature will be charged to you without your explicit choice and acceptance of the related conditions.
We may change, add, suspend or discontinue features of the service, including for technical, security or legal reasons. For significant changes we will notify you, where possible, with reasonable notice.
3. Who can use the service
To create an account you must be at least 14, or the higher age required in the country where you live to sign up for online services on your own. By signing up you declare, under your own responsibility, that you meet the required age: a false declaration leads to the account being closed.
If you are under 18 you may use the service only with the consent of the person with parental responsibility for you, who is responsible for your use of the service. Some content about the shows discussed (e.g. violence or adult themes) may not be suitable for all ages.
You may not use the service if we have closed an account of yours for serious violations, unless we authorize it, or if the law of your country forbids it.
4. Your account
You must provide true information and keep it up to date. Each person may have only one personal account, which cannot be transferred, sold or shared.
Usernames and display names may not impersonate other people, brands or staff, nor be offensive, misleading or infringe others' rights. We may ask you to change them or change them ourselves in case of violation.
You are responsible for keeping your password confidential and for everything that happens with your account. If you suspect unauthorized access, change your password immediately and write to support@spoilery.social.
You can delete your account at any time from Settings. Accounts inactive for more than 24 months may be closed after an email notice sent at least 30 days in advance.
5. Your content
The content you publish remains yours. By publishing it you grant us a free, non-exclusive, worldwide license, transferable to our technical providers, to host, store, reproduce, display and adapt it to the format of pages and devices, translate it automatically at users' request, create sharing previews and allow it to be shared through the service's features, solely to operate and promote the service.
The license ends when you delete the content or your account, except for copies already shared by other users outside the service, backups being overwritten and anything we must keep by law or to handle disputes.
You guarantee that you hold all necessary rights to the content you publish (including third-party images and texts and the rights of people portrayed) and that it doesn't break the law or these Terms. You alone are responsible for your content and the consequences of publishing it.
We have no general obligation to check content before it is published (Art. 17 of Italian Legislative Decree 70/2003 and EU Regulation 2022/2065, the "Digital Services Act"), but we act on illegal or rule-breaking content when we become aware of it.
The service is not an archive: keep a copy of the content you care about. You can download your data from Settings.
6. The spoiler rule
Respecting people who aren't caught up is the community's main rule. Content revealing the plot of an episode must be published only in that episode's room (or later episodes' rooms), where it stays covered for those who haven't watched it, or, in general discussions, marked as "Contains spoilers".
Spoilers are not allowed in titles, bios, names, profile pictures, unmarked general discussions or comments on posts about earlier episodes. Deliberately revealing the plot of later episodes is a violation and may lead to content removal and action on the account.
7. Rules of conduct
By using the service you agree not to publish or spread content that is illegal, defamatory, offensive, threatening, harassing or that incites hatred, violence or discrimination based on origin, religion, gender, sexual orientation, disability or any other personal characteristic.
The following are forbidden: sexually explicit or pornographic content; any content that sexualises or endangers minors; content promoting self-harm, eating disorders, terrorism or criminal activity; gratuitous graphic violence.
The following are forbidden: publishing other people's personal data without consent (addresses, phone numbers, documents, private photos), harassing or stalking other users, including outside the service, and evading a block with other accounts.
The following are forbidden: links or instructions to watch shows illegally, uploading episodes or substantial parts of protected works, selling or advertising products and services without our permission, spam, chain messages, scams and misleading or malicious links.
The following are forbidden: impersonating another person, staff or a brand; creating fake or multiple accounts to manipulate reactions, ratings, charts or reports; sending false or bad-faith reports.
The following are forbidden: accessing or attempting to access other people's accounts or restricted areas; using bots, scrapers or automated systems to collect data or publish content; overloading, attacking or compromising the service; circumventing limits, blocks or security measures; decompiling or copying the software, except as permitted by law.
The rules apply to all content: posts, comments, images, names, bios, profile pictures and covers, and also to help requests.
8. Reporting illegal content and copyright
You can report posts, comments and users with the "Report" button. For content you believe is illegal (e.g. copyright infringement, defamation, personal data published without consent) you can also write to support@spoilery.social stating: the link to the content, why you believe it is illegal, your name and email and a statement that the report is made in good faith and the information is accurate. For copyright infringements also state the protected work and the rights holder.
We review reports in a timely, diligent and objective manner and, if you have left us a contact, we inform you of the decision taken. Users who abuse reporting by repeatedly sending manifestly unfounded reports may be suspended from reporting.
For communications from authorities and users under the Digital Services Act, the point of contact is info@spoilery.social (languages: Italian and English).
9. Moderation and measures
Staff review reports and violations and, depending on severity and repetition, may: cover or hide content, remove it, restrict some features, temporarily suspend the account or close it permanently (ban). In serious or urgent cases (e.g. illegal content, danger to others, attacks on the service) we may act immediately and without notice.
When we take a measure we tell you, unless prohibited by law, what was done and why, by email and, if you can still sign in, with a notification on the site. If you disagree you can contest it within 6 months by writing to support@spoilery.social or using the help center: the request will be reviewed by a member of staff and we will reply. Your right to turn to an out-of-court dispute settlement body or to the courts is unaffected.
We use automated systems to order content (see section 11). For moderation we may use automated support tools against spam and abuse, but decisions on removals and accounts are made or reviewed by staff.
10. Specific features
Machine translation: translations of posts and comments are generated by automated services and may contain errors. The original text remains the author's.
History import: you may only import files that belong to you. We do our best to recognize series and episodes, but we don't guarantee that the import is complete or accurate.
Catalog and "Where to watch": titles, plots, release dates, images and streaming platforms come from external sources (TMDB and JustWatch) and may be incomplete, outdated or wrong, including air times and availability in your country.
Notifications: push and email notifications also depend on external services and your device; we don't guarantee that they always arrive or arrive in real time.
Sharing: links shared outside the service show a public preview of the content; episode posts and posts marked as spoilers don't show their text in the preview.
11. How we rank content
The home feed mixes posts from the series and people you follow with other posts you might like. The order depends mainly on: followed series and people, publication date, reactions and comments received, the post's language compared to yours, posts we have already shown you and a random component that changes on every visit. Suggested series depend on the genres of the series you watch, what users with similar tastes follow, ratings and popularity.
You can influence the feed by following or unfollowing series and people, blocking users, using the post-type filters and the "Hide spoilers" option. Episode rooms and series pages show posts in chronological order, with priority given to those in your language.
12. Intellectual property and trademarks
The name, logo, design, site texts and software of Spoilery belong to Gianluca Maria Vitrano or its licensors and are protected by law. You may not use them without written permission, except to mention or share the service in the ways provided.
Titles, images, characters and trademarks of the shows belong to their respective owners and are used for information and discussion purposes only. Spoilery is not affiliated with or endorsed by producers, distributors or streaming platforms. Some data comes from TMDB: this product uses the TMDB API but is not endorsed or certified by TMDB. Streaming platform data is provided by JustWatch.
If you send us ideas, suggestions or feedback about the service, we may use them freely to improve it, with no obligation to pay you.
13. Third-party services and links
The service may contain links to external sites and allows sign-in with Google and sharing on other platforms. We don't control these services and are not responsible for their content, availability or how they process your data: their use is governed by their own terms.
14. Availability of the service
We strive to keep the service secure and working, but it is provided "as is" and "as available": we cannot guarantee that it will always be free from errors, interruptions or delays, or that content will always be preserved. There may be interruptions for maintenance, updates, provider failures or force majeure.
If we decide to close the service permanently, we will announce it at least 30 days in advance so you can download your data.
15. Limitation of liability
Content published by users expresses the opinions of their authors, who are personally responsible for it. We are not responsible for users' content or behavior, on or off the service, except as provided by law for hosting service providers.
To the extent permitted by law, we are not liable for indirect or consequential damages, loss of data or content, loss of profit or damages arising from service interruptions, inaccurate catalog information or the use of third-party services.
These limitations don't apply in cases of wilful misconduct or gross negligence, to personal injury or wherever the law does not allow liability to be excluded or limited. The rights granted to consumers by the Italian Consumer Code (Legislative Decree 206/2005) and other mandatory rules always remain unaffected.
16. User responsibility
You are responsible for your use of the service. Within the limits of the law, you agree to hold Gianluca Maria Vitrano harmless from claims, damages and costs (including reasonable legal fees) brought by third parties because of content you published or your violations of these Terms or of others' rights.
17. Duration, withdrawal and account closure
These Terms apply for an indefinite period from the moment you create your account. You can withdraw whenever you want, at no cost and without giving reasons, by deleting your account from Settings.
We may suspend or close your account in case of violation of the Terms or the law, as described in section 9, or, through no fault of yours, with at least 30 days' notice (e.g. if the service closes).
When the account is closed your content is deleted or anonymised as described in the Privacy policy. Sections that by their nature must continue to apply (e.g. liability, indemnity, governing law) remain valid after closure.
18. Communications
We may send you communications about the service, your account and changes to our documents via your account email, notifications or notices on the site. Keep your email address up to date.
You can contact us at info@spoilery.social or, for support, at support@spoilery.social and through the site's help center.
19. Changes to the Terms
We may update these Terms for new features, technical or security needs or changes in the law. Significant changes will be communicated at least 15 days in advance on the site or by email, except those required by law or necessary for security reasons, which may take effect immediately.
If you don't accept the changes you can delete your account before they take effect; by continuing to use the service after that date you accept them.
20. Governing law and disputes
These Terms are governed by Italian law. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of your country.
For any problem please write to us first at info@spoilery.social: we will look for an amicable solution. You may also use mediation or other alternative dispute resolution methods provided by law.
For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction. In other cases, the court of the place where Gianluca Maria Vitrano is established has jurisdiction.
21. Final provisions
If any clause of these Terms is found void or ineffective, the others remain valid. If we don't immediately enforce one of our rights, this doesn't mean we waive it.
We may transfer the contract to another party that continues the service, informing you beforehand and without reducing your rights; you may not transfer it without our consent.
The Terms are available in Italian and English; in case of differences the Italian version prevails, subject to consumer protection rules.
